Agreement on the provision of services to assist in employment
Limited Liability Partnership "DIGITAL INNOVATIONS GROUP" (TIN 304133210), hereinafter referred to as the "Contractor", represented by Director Yusupov A.B., acting on the basis of the Charter, provides any capable individual who has reached the age of 18, hereinafter referred to as the "Applicant", with services to assist in employment by providing various services of the Contractor's Websites.
Unconditional acceptance of the terms of this offer is considered to be registration on one of the Contractor's Sites (clause 1.1. of the Agreement) or the performance by the Applicant of any actions aimed at any use of the Contractor's Sites, including searching for and viewing vacancies, responding to vacancies, or any other actions aimed at using the services or functionality of the Contractor's Sites.
Acceptance of this offer (Agreement) on terms other than those specified in this offer, or acceptance under a condition, is not permitted.
Terms and definitions
1.1. The Site is the content of Internet pages located on the Internet at the address of any of the domains managed by the Contractor, including but not limited to http://www.resume.uz, which is used by the Job Seeker in accordance with this Agreement both directly at the relevant addresses and through other sites and applications.
1.2 Registration on the Site is the procedure for creating an account on the Site and receiving account information by the Job Seeker. Registration is made on the basis of data voluntarily and knowingly provided by the Job Seeker to the Site both directly, through the registration forms of the Site (including through the Contractor's mobile application), and through other sites and applications.
1.3. Job Seeker is a visitor to the Site who has registered on the Site for the purpose of finding a job, or who also uses the Site to find a job, but without registering on the Site.
1.4. The resume.uz database is a collection of Job Seekers' resumes located on the Internet at the domain address http://resume.uz.
1.5. Job Seeker's account information is a login and password for entering the secure pages of the Site. The email address or phone number that supports receiving short text messages (SMS) specified by the Job Seeker when registering on the Site is used as a login.
1.6. Resume is a document containing the Job Seeker's personal data, including information about the last name and first name, email address, education, description of places of work, as well as other data related to the job search.
1.7. The Client of the Site is any legal entity or individual registered on one of the Sites managed by the Contractor, who has received a unique login and password to enter the secure pages of the relevant Contractor Site.
1.8. Anonymous User of the Site is a legal entity or individual who is not registered on any of the Contractor Sites or is registered only on one of them, but who uses the services of the Site(s) available to him/her, on which he/she is not registered at the time of using such Site.
1.9. Application — software (computer program) of the Contractor for operation on mobile devices with the iOS and Android operating systems, and having functionality that provides the Applicant, if he uses such software, the ability to search for work and other types of data by using the data, services and functionality contained on the website https://resume.uz.
Subject of the agreement
2.1. The Contractor undertakes to provide the Applicant with the opportunity to post a Resume on the Website, search for vacancies published on the Website and create responses to them.
2.2. In accordance with the Law of the Republic of Kazakhstan dated May 21, 2013 No. "On personal data and their protection" and the Law of the Republic of Uzbekistan dated April 16, 2019 No. ZRU-547 "On personal data", the Applicant hereby gives his consent to the collection and processing of personal data for the purposes specified in paragraph 2.3 of this Agreement, and expresses his consent to the Contractor to carry out the following actions with all personal data specified by the Applicant upon registration on the Site or subsequently on the Site, including in the relevant Resume: distribution (only in relation to the Resume or data from the Resume), collection, systematization, accumulation, storage, clarification (updating or changing), use, provision, access, blocking, destruction, processing, search and collection of information about the Applicant from publicly available sources of information based on the information specified in the Resume.
2.2.1. The Applicant also expresses his/her consent to the Contractor for the purposes specified in paragraph 2.3 of this Agreement, to collect data on the geolocation of the Applicant, which is carried out only if the Applicant has appropriately configured his/her mobile device in relation to the installed Application, as well as when the Applicant uses this Application. By appropriately configuring his/her mobile device in relation to the Application, the Applicant
may also refuse to collect geolocation data. The Applicant also expresses his/her consent to the Contractor for the purposes specified in clause 2.3 of this Agreement, to collect data on the home address in the Applicant’s personal account on the Sites if the Applicant indicates this address in the corresponding line when filling in personal data, as well as to the use of such data for the purpose of providing employers with information on the approximate distance to the place of work/employment for the relevant vacancy of employers. In the same way, the Applicant may refuse to collect data on the home address by deleting this address when editing his/her personal data.
2.3. The purpose of processing the personal data of the Applicant includes the following:
2.3.1. Identification of the Applicant as a party to this Agreement and personalization of the services provided by the Site,
2.3.2. Opportunity for employment or other types of employment with Clients, as well as conducting a preliminary interview for the purposes of employment or other types of employment with Clients, provision of services/performance of work by the Applicant to the Client on the basis of a civil law contract;
2.3.3. Sending notifications, requests and information regarding the use of the services of the Site, contacting in other ways to fulfill this Agreement, processing requests and appeals from the Applicant;
2.3.4. Improving the quality of the services of the Site, the ease of use, developing new services of the Site;
2.3.5. Targeting advertising materials;
2.3.6. Sending any information messages, including advertising;
2.3.7. Conducting statistical and other research;
2.3.8. Fulfilment by the Contractor of its obligations under this Agreement.
2.4. The period for posting personal data in the Resume form (the period for providing consent in accordance with paragraph 2.2. of this Agreement) is unlimited and is determined independently by the subject of personal data (Applicant).
2.5. Nothing in this agreement may be understood as establishing between the Contractor and the Applicant agency relations, partnership relations, joint activity relations, personal employment relations, or any other relations not expressly provided for in this agreement.
2.6. When the Job Seeker responds to a particular vacancy, the potential employer of this vacancy may ask questions, the results of the answers to which remain with this employer and are not communicated to the Job Seeker, or the potential employer may offer the Job Seeker to take a test from such potential employer on the Site. At the same time, no questions from employers and the Job Seeker's answers to them can be understood as the only criterion for hiring. The Job Seeker's answers to the questions of a potential employer are confidential. All responsibility for the confidentiality of the Job Seeker's answers lies with the relevant potential employer. If the test is passed by the potential employer, a report is generated based on the results of its completion, which is available for viewing only to this potential employer. At the same time, the Job Seeker is not provided with the contents of such report. The Job Seeker has the right to refuse to take any test on the Site from a potential employer. The Job Seeker's answers to the questions and the content of the report on the test results from a potential employer are confidential. All responsibility for the confidentiality of the Job Seeker's answers and the content of the report on the test results from a potential employer lies with the relevant potential employer.
2.7. The Client's response "Invitation" is not equivalent to and does not mean a formal invitation to work for a specific employer and does not entail the obligation of the Client to conclude an employment contract with the Job Seeker or conclude a civil law contract. The response of the potential employer "Refusal" is not equivalent to and does not mean a refusal to hire or to conclude an employment contract or a civil law contract.
2.8. The Job Seeker expresses his/her consent to the Contractor that when he/she calls the telephone number specified in the vacancy of the potential employer, such call will be recorded and analyzed by the Contractor or third parties involved by the Contractor for such recording and analysis. This recording and analysis will be made in order to improve the Contractor's service, as well as to increase the response of employers to Job Seekers' calls. The potential employer with whom such a telephone conversation was made will retain a recording of such telephone conversation. The Job Seeker also expresses his/her consent to the Contractor processing (collection, systematization, accumulation, storage, clarification (updating or modification), use, provision, access, blocking, destruction) of the fact of refusal/invitation to work, date and time of the scheduled interview, telephone number, as well as other personal data voiced by him/her during a conversation with a potential employer using the means
in automation or without the use of such means. The Applicant also hereby expresses his consent to the Contractor to entrust the processing of personal data to a third party engaged by the Contractor on the basis of a relevant agreement concluded with this person, in order to achieve the specified goal and subject to maintaining the confidentiality of the data. The term of this consent is valid until the Applicant revokes this consent.
2.9. The Contractor does not pay any deductions and/or remuneration to the Applicant for the implementation of the actions with the Resume specified in clause 2.2. of this Agreement.
2.10. The Contractor is not responsible for maintaining confidentiality and/or for the actions of third parties with the personal data of the Applicant, including those posted by the Applicant on the Website in the form of a Resume, as a result of the Applicant establishing certain Resume visibility settings (clause 3.1.3).
2.11. In order to fulfill the obligations under this Agreement and achieve the purpose of processing the personal data of the Applicant (clause 2.3. of the Agreement), the Applicant grants consent to the Contractor to distribute and transfer the personal data of the Applicant provided by the Applicant in the form of a Resume to any third parties located in the territory of any foreign state (the Contractor's right to cross-border transfer of the Applicant's personal data to any third parties).
2.12. The posting of personal data by the Applicant on the Website in the form of a Resume can be done either directly by the Applicant by filling out a special form on the Website, or automatically - by providing consent to the Website (as well as other websites) programmatically or otherwise to receive (transfer) personal data for the compilation of a Resume from another (other) website on which the personal data of the Applicant is located with his consent. When transferring personal data from another site, the Applicant is identified by the email and phone number specified by him/her when registering on the Site.
2.13. In case of automatic compilation of the Resume (clause 2.10.), after the Site programmatically generates the draft Resume, the Applicant has the right to either confirm the posting of such Resume on the Site or refuse to post it.
2.14. By concluding this Agreement, the Applicant expresses to the Contractor his/her consent to the provision by the Contractor of an order for the processing of the Applicant's personal data posted in the form of a resume on the Site, specified by the Applicant when registering on the Site or subsequently on the Site, to any third party on the basis of a relevant agreement concluded with this person.
2.15. By this Agreement, the Job Seeker gives his consent to receive messages from the Contractor via telecommunication networks, namely: calls, mailings via mobile radiotelephone networks (SMS), as well as mailings made via instant messaging systems in real time via the Internet (messengers WhatsApp / Viber and others) using the contact information specified by the Job Seeker in his Resume on the Site, or during his registration on the Site or subsequently on the Site. The Job Seeker gives his consent to the following messages specified above in this paragraph (including mailings and calls) from the Contractor: informing about the services of the Contractor, including the services of the Site; responses (invitations) from potential employers, recruiting agencies and recruiters in response to the Job Seeker's Resume posted on the Site or the Job Seeker's response to a vacancy posted by someone, if such mailings are made through the Site; including advertising.
2.15.1. The Job Seeker hereby gives his consent to receive informational messages from the Contractor via social networks, including VKontakte and Odnoklassniki, as well as real-time instant messaging systems via the Internet (including WhatsApp/Viber, Telegram and other messengers), including messages: related to the possible subsequent employment of the Job Seeker with a potential employer, about vacancies that could be potentially interesting or suitable for the Job Seeker.
2.16. By this Agreement, the Applicant gives his/her consent to the processing of personal data about the current connection in terms of statistical information:
— user ID assigned by the Site;
— pages visited;
— number of page visits;
— information about navigation through the pages of the Site;
— duration of the user session;
— entry points (third-party sites from which the user follows a link to the Site);
— exit points (links on the Site by which the user follows a link to third-party sites);
— user country;
— user region;
— time zone set on the user's device;
— user provider;
— user browser;
— user search queries, including search queries relative to the location specified by the user;
— browser canvas fingerprint;
— available browser fonts;
— installed browser plugins;
—
WebGL browser parameters;
— type of available media devices in the browser;
— presence of ActiveX;
— list of supported languages on the user's device;
— architecture of the user's device processor;
— user OS;
— screen parameters (resolution, color depth, page placement parameters on the screen);
— information on the use of automation tools when accessing the Site;
— non-personalized information about data input parameters, mouse movement parameters, key combinations used without saving the data entered by the user.
The collection of this information is carried out both by the mechanisms of the Site itself and by the mechanisms of third-party Internet services, including, but not limited to:
— LiveIntenet;
— Rambler.top100;
— ComScore;
— TopMail.ru;
— Google Analytics;
— Yandex.Metrica;
— Group-IB Secure Portal.
The collection of the specified information is carried out for the purpose of generating statistics on the use of the Site and ensuring the security of the Site. In relation to registered users of the Site, information on the use of ports on users' devices may be collected in order to identify suspicious activity and protect users' personal accounts. The Contractor has the right to change the list of third-party Internet services used without notifying the Applicant. Third-party Internet services ensure the storage of received data on their own servers, the Contractor is not responsible for the localization of the servers of third-party Internet services. The Contractor does not compare personal data on the current connection and information provided by the Applicant in the Resume form and allowing the identification of the Applicant.
2.18. The Contractor has the right to send messages to the Applicant who has installed the Application via the Application to the Applicant’s mobile device using push notification technology. By installing the Application on their mobile device, the Applicant gives their consent to receive push notifications, which may, among other things, contain advertising information.
2.19. The Applicant who has not logged in to the Application using their account information on the website https://resume.uz may opt out of receiving push notifications through the settings of their mobile device in relation to the installed Application.
2.20. The Applicant who has logged in to the Application using their account information on the website https://resume.uz may customize the subject of the received push notifications or completely opt out of receiving them through the settings of their profile in the Application.
2.21. The Job Seeker agrees that his outgoing and incoming electronic messages with a potential employer are automatically processed by the Contractor's programs for the full transmission, reception and storage of messages, including analytical processing for statistical research necessary to provide the Job Seeker with the full functioning of the Site and the Application, including, but not limited to, job recommendations and ranking of job search results.
Contractor's Obligations
3.1. The Contractor undertakes to:
3.1.1. provide the Job Seeker with the opportunity to create a Resume and store no more than 20 Resume on the Site (save in the resume.uz Database);
3.1.2. provide access to the Site Clients and Anonymous Site Users to the Job Seeker's Resume;
3.1.3. provide the Applicant with the ability to manage access to their Resume and set Resume visibility settings at their discretion;
3.1.4. provide the Applicant with the ability to respond to vacancies published on the Site, but no more than 200 times (no more than 200 responses) in total for all vacancies of interest to the Applicant on the Site within 24 hours in a row (regardless of the number of the Applicant's resumes available on the Site at that moment); provide the Applicant with the ability to create cover letters and receive messages by e-mail and SMS (if the mobile phone number is specified correctly) and/or messages through the Site functionality from the Site Clients who have published vacancies.
3.1.5. provide the Applicant with the ability to delete the Resume at any time at their own discretion.
3.2. The Contractor has the right, at its own discretion, to delete the Resume or refuse to post it without explanation.
3.2.1. The Contractor has the right to block (or delete) the Applicant's account on the Site without the possibility of restoring it if, over a period of 7 calendar days, the Applicant has received a total of 2 (two) complaints from different Clients of the Site through the use of the special functionality of the Site (the "complain" button).
3.2.2. The Contractor has the right, at its own discretion, to block (or delete) the Applicant's account on the Site without the possibility of restoring it if the Contractor has doubts about the Applicant's compliance with Section 4 of this Agreement, including if the Contractor has information about the relevant violations and / or grounds to believe that a violation of any of
the specified points of this Agreement.
3.3. The Contractor has the right, at any time and without prior notice, to send informational messages about the events of the Contractor's company, about the services of the Site and the services of the Contractor and other information, including advertising, to the e-mail address specified by the Applicant when registering on the Site.
3.4. The Contractor has the right to publish the Applicant's Resume in any way, by any means and on any media, including by posting it on the Site and/or including it in the resume.uz Database, while the Contractor does not make any deductions and/or remuneration payments to the Applicant.
3.5. The Contractor has the right to, in any way and without any restrictions, derive profit from the processing and publication of personal data (including by providing third parties with access to them) of the Applicant, posted by the Applicant on the Website (in the resume.uz Database) in the form of a Resume, while the Contractor does not make any deductions and / or pay remuneration to the Applicant.
3.6. The Contractor has the right at any time to make demands on the content of the Resume posted by the Applicant on the Website, related to the clarification, visual presentation and structuring of data, including decoding of abbreviations and acronyms contained in the Resume, as well as for the purpose of compliance of the Resume with the Moderation Rules.
3.7. In the event of failure by the Applicant to comply with the Contractor's requirements presented by the Contractor in accordance with clause 3.6. of this Agreement, the Contractor has the right to refuse to post the CV of the Applicant in respect of whom the Contractor has made any demands.
3.8. Using the contact information specified by the Applicant in the CV on the Site, the Contractor has the right, independently or with the involvement of a third party who has been instructed by the Contractor to process the personal data of the Applicant in the form of the CV, to make calls for the purpose of conducting a preliminary interview and/or informing about vacancies that could be potentially interesting or suitable for the Applicant, for the purpose of his possible subsequent employment or other type of employment with potential employers, in connection with which, by concluding this Agreement, the Applicant gives his consent to such actions. The Applicant also agrees that the information received as a result of such calls may be provided to potential employers for the purpose of employment or other types of employment of the Applicant with potential employers.
3.9. The Contractor has the right, on the basis of any information and personal data specified in the Applicant's Resume on the Site, to provide its customers with the technical ability to search third-party sites, including social networking sites, for any public (publicly accessible) profiles (accounts) of the Applicant and to provide the customer with the technical ability to display the results of such a search in its interface on the Site. In this case, the Contractor does not bear any responsibility and does not compensate for any possible damage for the compliance of the search results, as well as for the adoption of any decision based on the results of such a search in relation to the Applicant by the relevant customer of the Contractor as a potential employer.
3.10. The Contractor has the right, on the basis of the contact information specified in the Resume, to send and/or provide its customers with the opportunity to send informational messages to the Applicant related to his possible subsequent employment with a potential employer, about vacancies that could be potentially interesting or suitable for the Applicant through the social networks VKontakte and Odnoklassniki, including with the involvement of a third party.
3.11. For the purposes of paragraph 3.6., identification of the Applicant as the subject of personal data and a party to the Agreement, when restoring account information (access to the account) on the Site at the request of the Applicant, including requests from the Applicant to delete his personal data from the Site in the form of a Resume or account, when the Applicant has lost his account information, the Contractor has the right to request from the Applicant confirmation of his identity in the form of presentation of his passport or other identity document (including the right of the Contractor to make copies of such documents and the right to request copies of such documents from the Applicant with the subsequent destruction of the copies received within a period not exceeding 30 days after the said identification).
3.12. The Contractor has the right to periodically conduct experiments for the purpose of improving the quality and developing the functionality of the Site, as well as studying potential demand, within the framework of which it is possible to replace the names of the components of the Site and the Contractor's application (for example, the names of buttons, sections, etc.). This replacement of names does not entail a change in the terms of this Agreement.
Obligations of the Applicant
4.1. The Applicant undertakes not to commit the following actions:
4.1.1. In any way, through the Site, post, distribute, save, download and/or destroy
materials (information) in violation of the legislation of the Republic of Kazakhstan and international legislation.
4.1.2. Post and/or transmit via the Site information in the form of text, images, sound or program code that may be illegal, advertising, threatening, offensive, slanderous, knowingly false, rude, obscene, harm other visitors to the Site, violate their rights and legitimate interests.
4.1.3. Implement executable code on the user's side (client scripts: java-script, visual basic-script, etc.), any implemented objects (java-applets, flash, etc.), use frame and iframe, cascading style sheets that override those used on the Site, as well as html code that violates the original design of the page.
4.1.4. Introduce yourself under a false name or on behalf of someone else (an individual or an organization) — a job seeker registered on the Site, a representative of an employer organization, an employee of the Contractor. Mislead users and the Site administration regarding your identification in any other way.
4.1.5. Post knowingly false information.
4.1.6. Post ads advertising any franchise or "pyramid" schemes offering to "join the club", become a distributor, sales representative, "manager" or other employee of a company whose business model is based on the preliminary and/or periodic transfer of funds from lower-level employees to higher-level ones, implying payment for work only in the form of a percentage of sales and/or requiring the involvement or hiring of other agents, distributors, "managers", "club members" and the like.
4.1.7. Post and/or transmit materials using the Site if the Applicant does not have the appropriate rights to do so. This applies to materials protected by copyright, trademarks, patents, as well as non-dissemination agreements, confidentiality agreements, and the like.
4.1.8. Destroy and/or change any materials on the Site that the Applicant is not the author of.
4.1.9. Print or otherwise copy and use personal information, except for your Resume.
4.1.10. Use information about telephone numbers, postal addresses, email addresses for purposes other than the subject matter of the Site (questions of hiring, selection of candidates, offers of positions and candidates, etc.).
4.1.11. Register using someone else's e-mail address, or an address that the Applicant does not have the right to use in this way.
4.1.12. Post vacancies of any employers, namely offers of employment opportunities with any employers.
4.1.13. Post phone numbers(s) that the Applicant does not have the right to use, or the number belongs to legal entities.
4.2. The Applicant, by accepting this offer, expresses his full and unconditional consent to receive any informational messages, including advertising, from the Contractor by e-mail in accordance with paragraph 3.3. of the Agreement.
4.3. The Applicant undertakes to regularly familiarize himself with the contents of this Agreement in order to promptly familiarize himself with its changes.
4.4. The Applicant has the right at any time, at his own discretion, to revoke his consent to the processing of his personal data (presented in the form of a Resume) by the Contractor, including by independently deleting any specific or all of his Resume posted on the Site. For this purpose, the Applicant is provided with the appropriate technical capability (interface) on the Site.
4.5. The Applicant has the right at any time, at his own discretion, to delete his account (registration) on the Site, including all data related to this account (registration), by sending a corresponding request (request to delete the account) to the resume.uz Support Community, located at the address: http://feedback.resume.uz, or by sending a corresponding request (request to delete the account) to the email address feedback@resume.uz, using the same email address as when registering his account (registration) on the Site as the address for sending such a request.
Information security of the Site
By using the Site, the Applicant undertakes not to violate or attempt to violate the information security of the Site, which includes:
5.1. access to data not intended for this Applicant or logging into the system under a login that does not belong to this Applicant;
5.2. attempts to test the vulnerability of the Site's security system, violation of the registration and authorization procedure without the Contractor's permission;
5.3. attempts to interfere with the use of the Site by other users, which includes the distribution of computer viruses, data corruption, constant sending of repetitive information, forwarding e-mail through the site's server, simultaneous sending of a large number of e-mails and/or requests to the Site with the purpose of deliberately putting the site's server out of order, and the lik
e. actions that go beyond the normal intended use of the Site and may intentionally or negligently cause its malfunction;
5.4. sending users of the Site materials to which they have not given their consent, "spam", any letters and advertisements without the permission of the Contractor;
5.5. imitation and/or forgery of any TCP/IP packet header or any part of the header in any email or material posted on the Site;
5.6. using or attempting to use any software or procedure for navigation or search on the Site, except for the search engine built into the Site and traditional and public browsers (Microsoft Explorer, Mozilla Firefox and others similar).
5.7. using software that imitates the work of the Applicant on the Site, including in the Contractor's application.
5.8. Violation of the security of the system or computer network by the Applicant or attempts to violate it entails civil and criminal liability. The Contractor will investigate all cases of possible violation of security or attempts to violate it by all users of the Site in cooperation with law enforcement agencies in order to prevent such malicious activity.
Protected sections of the Site and passwords
6.1. Access to information located on the protected sections of the Site is permitted only to registered users who have received a password for entering the protected sections of the Site. The password cannot be transferred to other persons, and the Applicant is fully responsible for all damage caused to him, the Contractor or third parties, arising from the intentional or unintentional transfer of the password by the Applicant to another person. The Applicant is responsible for maintaining the confidentiality of the password and any use of the Site using his password.
User information
7.1. The Contractor shall make every possible effort to avoid unauthorized use of the personal data of the Applicant.
7.2. The Contractor shall not be liable for possible misuse of the personal data of Applicants that occurred due to:
technical problems in software, servers or computer networks beyond the control of the Contractor;
interruptions in the operation of the Site related to intentional or unintentional use of the Site for other purposes by third parties, as described in the section "Information Security of the Site";
transfer of passwords or any information, including both the Resume as a whole and its individual parts or data, from the Site by users to other persons who are not registered users of the Site or other users who do not have access to this information due to the terms of registration and contracts concluded with the Contractor;
violation of the information security of the Site;
violations of the terms of agreements for the use of the resume.uz Database by the relevant contractors of the Contractor (Clients of the Site);
7.3. By using the Site, the Applicant agrees and accepts that the Contractor reserves the right to use his personal data, including that presented in the form of a Resume, anonymously and in a generalized form for statistical purposes, as well as for targeting advertising placed on the Site.
7.4. The Contractor undertakes not to provide any personal data of the Applicant to individuals and legal entities that declare the possible misuse of such information (sending unauthorized advertising, spam, providing information to other persons, etc.). The Contractor undertakes not to provide any personal data of the Applicant to individuals and legal entities that declare the possible misuse of such information (sending unauthorized advertising, spam, providing information to other persons, etc.). At the same time, when using the Data Exchange application, the Contractor has the right to transfer the depersonalized data of the Applicant to third parties for the purpose of improving the quality of services provided by the Sites, as well as advertising segmentation. The Applicant can independently disable the use of the Data Exchange application in his personal account.
7.5. By using the Site, the Job Seeker agrees and understands that when he/she sends a response to a particular vacancy posted on the Site by a recruiting agency, organization or other person providing personnel search and selection services, the said persons have the right to transfer the personal data of this Job Seeker in the form of a Resume to their clients (customers) for the purpose of considering the Job Seeker as a potential candidate for vacant positions with these clients (customers). The Job Seeker also agrees and understands that when using the Resume visibility settings that allow access to it by recruiting agencies, organizations or other persons providing personnel search and selection services, the relevant recruiting agencies, organizations or other persons have the right to transfer the personal data of this Job Seeker in the form of a Resume to their clients (customers) for the purpose of considering the Job Seeker as a potential
candidate for vacant positions with these clients (customers). At the same time, such a recruiting agency, organization or other person who has posted any vacancy on the Site has no way of establishing that in relation to their clients (customers) on the Site the Applicant has established any limitation of visibility (accessibility) of the Applicant's Resume.
7.6. The Applicant agrees that his outgoing and incoming electronic messages with a potential employer are automatically processed by the Contractor's programs for the full transmission, reception and storage of messages, including analytical processing for statistical research necessary to provide the Applicant with the full functioning of the Site and the Application, including, but not limited to, vacancy recommendations and ranking of vacancy search results.
Financial relations
8.1. The Contractor's services provided in accordance with clause 2.1. of this Agreement for Applicants are FREE OF CHARGE.
8.2. The Contractor is not a representative of either Applicants publishing their resumes on the Site, or of the Site Clients posting vacancies, and therefore cannot be held liable for any obligations (including financial) arising between the two. Any agreements between Applicants and Site Clients are bilateral, and the Contractor has nothing to do with them.
Use of Site Materials
9.1. Each user of the Site, Applicant or representative of the Site Client, is responsible for the information posted on his behalf and for the consequences of this posting.
9.2. The Site is only a means of transmitting information and in no case is liable for its accuracy and relevance.
9.3. The Contractor makes every possible effort to exclude careless, inaccurate or knowingly incomplete information from the Site, however, ultimately, responsibility for it lies with the persons who posted it.
9.4. When reprinting and otherwise using materials from the Site that are not Job Seekers' Resumes, company or vacancy descriptions, as well as the logo, design elements, appearance and structure of the Site, a link to the Site is required.
9.5. The use of Job Seekers' Resumes, company and vacancy descriptions is unacceptable for any purposes other than those relevant to the subject matter of the Site (search for work, employees, obtaining information about the labor market).
9.6. If the Client of the Site saves the Job Seeker's Resume in its own database outside the Site, then the Client of the Site, as the operator of personal data, is responsible for this.
9.7. It is prohibited to use software (scripts, robots) to read or collect information (data) from the Site.
9.8. The logo, name, design elements, layout and general appearance of the Site are the intellectual property of the Contractor and their use without the express consent of the Contractor is prohibited.
9.9. Since the identification of users of the Sites is difficult for technical reasons, the Contractor is not responsible for the fact that registered users are really the people they claim to be, and is not liable for any possible damage caused to Applicants or other persons for this reason.
9.10. By using information from the Site, the Applicant understands and accepts the risks associated with the possible unreliability of the information posted on the Site, as well as the fact that some information may seem threatening, offensive, slanderous, deliberately false, rude, obscene. If this happens, the Applicant must immediately stop using the Site and notify the Contractor of the presence of such information.
9.11. The Contractor does not guarantee that the published Resumes will be viewed by a certain number of Clients of the Site or even by one.
9.12. The Contractor does not guarantee that the software, servers and computer networks used by the Site are free of errors and computer viruses. If the use of the Site resulted in the loss of data or damage to equipment, the Contractor shall not be liable for this.
9.13. The Contractor does not guarantee that the working conditions (e.g. job title, job responsibilities, salary and terms of remuneration, etc.) contained in the vacancies posted on the Site will correspond to those for which the Applicant was hired.
9.14. The Contractor shall not be liable for the content of the vacancies posted on the Site. The Clients of the Site who publish the relevant vacancies are responsible for the content of the vacancies posted on the Site.
Cookies
10.1. The Site software may transfer Cookies or data included in Cookies to the Applicant's software, just as the Applicant's software may transfer Cookies or data included in Cookies to the Site.
10.2. The Contractor has the right to use Cookies in any way for the purposes of identifying the Applicant, as well as for any other purposes, including the provision of personalized services and services Site
a, advertising targeting, conducting research and other purposes.
10.3. The content, structure and any other characteristics of Cookie files are determined by the Contractor at its sole discretion.
Law applicable to the relations of the Parties and dispute resolution
11.1. This Agreement, as well as the relations between the Applicant and the Contractor, including those not regulated by this Agreement, are regulated in accordance with the current legislation of the Republic of Uzbekistan.
11.2. All disputes between the Parties under this Agreement are subject to resolution by correspondence and negotiations using the mandatory pre-trial claim procedure for dispute resolution. The period for responding to a claim is 30 days from the date of receipt of the claim by the Party. In the event of failure to send a response to the claim by the Party within the specified period, the Party that sent the claim has the right to go to court. All claims to the Contractor must be sent to the address of the Contractor's location. In the event that it is impossible to resolve disputes through negotiations or in a claim procedure, they must be resolved in court at the place of state registration of the Contractor in the manner established by the current procedural legislation of the Republic of Uzbekistan.
Effectiveness of this Agreement, amendments
12.1. This Agreement shall be effective from the moment of its acceptance by the Applicant.
12.2. The Applicant, by concluding this Agreement, declares and guarantees that he has reached the age at which the Applicant is permitted to conclude this Agreement by the current legislation of the Republic of Uzbekistan, and the Applicant has the necessary legal capacity and capacity to conclude this Agreement.
12.3. The Contractor has the right, at its own discretion and without prior approval from the Applicant, to make amendments to this Agreement at any time. In such a case, the changes and additions shall come into force from the moment of their publication on the Site.
12.4. The use of the Site by the Applicant (as well as the exercise by the Applicant of the rights and obligations established by this Agreement) after any changes to this Agreement shall mean the Applicant's consent to such changes and/or additions.
12.5. If the Applicant does not agree to use the Site after the changes to this Agreement have been made by the Contractor and/or, accordingly, to comply with this Agreement after the changes, then the Applicant undertakes to stop using the Site and has the right to terminate this Agreement by sending a corresponding notice to the Contractor.
12.6. The Contractor has the right at any time, including in the event of a violation by the Applicant of the terms of this Agreement, to terminate this Agreement unilaterally without any prior notice to the Applicant about this and any compensation in connection with this to the Applicant. In the event of termination of this Agreement, the Contractor shall delete the Applicant's Credentials, the Resume posted by the Applicant on the Site, and other materials and information.
